Albius S.r.L. here below provides the Information on the protection of data pursuant to articles 13 and 14 of Regulation EU 2016/679 ("GDPR"), both as data controller of the personal data of users and of the health data of veterinary patients of its ownership or co-ownership, and also on behalf of the subjects and the professionals in the health professions ("Veterinary hospitals", "Veterinary clinics", "Freelance veterinarians"), operating within the Platform, who take care of a veterinary patient, at whom the health data and documents are drafted which are saved in the Veterinary Clinical File.
Who is the Data Controller?
In relation to the purposes referred to in point 2 of this Information, the data controller, pursuant to articles 4, number 7), and 24 of Regulation EU 2016/679, is Albius S.r.l. – Tax code and VAT no. 13058260962, with legal headquarters in Milan, Via Ercole Oldofredi, 45, registered in the Companies Register of Milan under no. REA 2700754, PEC: albiussrl@pec.it (hereinafter also the "Company" or "Albius"), with headquarters at Via Ercole Oldofredi, 45, 20124 Milan.
In relation to the processing of data contained in the Veterinary Clinical-Administrative File which summarizes the clinical-administrative path of the Veterinary Patient of Your Ownership, Co-ownership or Management, the controllers of the processing are:
Why do we process Your data?
As User or Related User, Your contact data (name, surname, tax code or VAT number, date of birth, place of birth, email address, phone number) and the clinical-administrative data related to a Veterinary Patient of your ownership, co-ownership or management, shared on the Platform by one or more subjects belonging to your VetTeam, as well as other special data inserted by You in the Platform (appointments, photos of patients, clinical history details etc.), will be processed by the Company for the purposes of:
a) sending service communications via email or SMS (or other messaging system);
b) processing of health data and of other special data deducible from clinical documents and other documents uploaded in the Veterinary Clinical-Administrative File to proceed to their anonymization in order to improve the services offered on the Platform and to optimize the care path of Veterinary Patients;
c) updating of the Veterinary Clinical-Administrative File (through the upload of additional documents), for optimal clinical management;
d) user management and detection of the satisfaction level of the Platform’s users;
e) use, upon your express consent, of your personal data for communication and marketing purposes, also focused on prevention and follow-up paths in the best interest of the patient, through tools such as, for example, sms and emails;
f) use, upon your express consent, of the veterinary health data of the Veterinary Patient(s) of your ownership, co-ownership or management to create a profile of the User or of the Related User and send personalized promotional communications also focused on prevention and follow-up paths in the best interest of the veterinary patient, through tools such as, for example, popups on the Platform, messages on the Platform, sms and emails.
What is the legal basis for processing Your Data?
The legal basis for the processing for the purposes indicated in letter a) of this paragraph 2, is the legitimate interest of Albius S.r.L. regarding technical news, new features and how to use them, temporary unavailability of the Service, and generally to provide you with information related to the Platform and its operation.
The legal basis for the processing for the purposes indicated in letters b), c), d), e) and f) of this paragraph 2, is consent. The provision of such consent is free and optional and does not affect the use of the Service.
How do we process Your Data?
The processing of Your personal data will be carried out through manual and IT tools, with logics strictly related to the stated purposes and, in any case, so as to guarantee the security and confidentiality of the Data itself.
In any case, the Company processes the personal data of the Data Subject, including the special data deducible from the information provided by the Data Subject, exclusively for the purposes indicated in point 2 (“purposes of the processing”) of this Information and, in any case, in compliance with articles 5 and 25 of Regulation EU 2016/679.
Which subjects may process your data for the purposes indicated in the Information?
The employees and/or collaborators of the Company in charge of managing the Platform and delivering the services requested via the Platform may become aware of your data. These subjects process the Data, as authorized and trained, exclusively for the purposes indicated in this Information and in compliance with the provisions of Regulation EU 2016/679. Furthermore, the third parties who will process the Data on behalf of the Company as “data processors,” identified pursuant to article 28 of Regulation EU 2016/679, as well as subjects who provide payment or consultancy services functional to the activity itself (as autonomous data controllers), may become aware of the personal data of the Data Subject, such as, by way of example and not exhaustive:
Structures (veterinary clinics and veterinary hospitals) and freelance veterinarians chosen by You (VetTeam), will also process the personal data as autonomous data controllers (and will, where appropriate, provide separate information on the processing), for administrative purposes and for the processing of clinical veterinary data related to the Veterinary Patients of Your Ownership, Co-ownership or Management.
Your data will not be disclosed.
How long and why will your Data be retained?
The data and documents uploaded by You or the data and documents shared with you by one or more members of your VetTeam will be stored in Your Veterinary Clinical-Administrative File as long as you have an account on the Platform.
If, as Data Subject, you decide not to use the Platform anymore, you will have the right to delete your Account, and a copy of it will be retained by the Platform for the time strictly necessary to protect the position of the Company or the position of the members of your VetTeam.
Do we transfer your Data outside the European Union / European Economic Area?
Your Data is stored in Data Centers located within the European Union / European Economic Area. However, some processing operations are conducted outside the European Union / European Economic Area but, in any case, by subjects located in countries and/or international organizations for which there is an adequacy decision by the European Commission, or on the basis of one of the other safeguards or derogations provided for by Chapter V of Regulation EU 2016/679 (GDPR).
What rights does Regulation EU 2016/679 grant you?
You have the right to exercise the rights under articles 15 to 22 of Regulation EU 2016/679.
In particular, you have the right to request from the Controller access to the personal data concerning you, to request rectification or erasure of the same or restriction of processing or to object to their processing, as well as the right to data portability.
After this Information is provided to you, you will be asked to give consent to the processing of your data; at any time, you have the right to revoke the given consent, without prejudice to the lawfulness of processing based on consent before the revocation.
As a Data Subject, you also have the right to lodge a complaint with a Supervisory Authority.
